Welcome to EduTrack! These Terms and Conditions ("Terms") govern your use of the EduTrack mobile application ("App") and related services ("Services") provided by EduTrack ("we," "us," or "our"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the App.

1. Use of Services

• Eligibility: EduTrack’s Services are designed for authorized users, including parents, guardians, and school administrators, who have registered with our App to monitor the GPS location of students during school-related transportation.
• License: We grant you a non-transferable, non-exclusive, revocable license to use the App strictly in accordance with these Terms and solely for the purpose of tracking students on authorized routes.

2. User Responsibilities

• Account Security: You are responsible for maintaining the confidentiality of your login credentials. Unauthorized access or sharing of your account may result in the suspension or termination of your access to the App.
• Accurate Information: You agree to provide accurate and current information when registering and updating any information in your account.
• Compliance with Laws: You are responsible for complying with all applicable laws and regulations while using our Services.

3. Location Tracking

• Purpose of Tracking: The App uses GPS technology to track students’ locations during school commutes. By using the App, you agree to the collection, storage, and sharing of this information with authorized guardians and school staff for safety and monitoring purposes.
• Location Accuracy: While we strive to provide accurate and reliable location data, we do not guarantee that the information will always be precise or without delays.

4. Data Privacy

• Personal Data: EduTrack respects your privacy. Our collection, storage, and use of personal information are governed by our Privacy Policy, which is incorporated by reference into these Terms.
• Third-Party Services: EduTrack may use third-party providers for hosting, data processing, and analytics. These third parties are bound by confidentiality agreements and are not permitted to use personal data beyond what is necessary to assist us.

5. Prohibited Uses

• You agree not to:
  • Reverse engineer, decompile, or disassemble any part of the App.
  • Interfere with the proper functioning of the App.
  • Use the App for any unauthorized or illegal purpose.
  • Disclose location data or personal information for non-educational purposes or share it without permission.

6. Modifications to the Service and Terms

• Service Modifications: We reserve the right to modify, suspend, or discontinue any part of our Services at any time without prior notice.
• Updates to Terms: EduTrack may update these Terms periodically. If significant changes are made, we will notify you through the App or other communication channels.

7. Disclaimer of Warranties

• As-Is Basis: The App and Services are provided "as-is" and "as available" without warranties of any kind, whether express or implied.
• Limitation of Liability: To the maximum extent permitted by law, EduTrack shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of your use or inability to use the App, including any inaccuracies in location data.

8. Indemnification

• You agree to indemnify and hold EduTrack harmless from any claims, damages, liabilities, costs, or expenses (including reasonable attorney fees) arising out of your use of the App, your violation of these Terms, or your infringement of any third-party rights.

9. Termination

• We reserve the right to terminate or suspend your account and access to the App without prior notice if we believe that you have violated these Terms or used the App inappropriately.

10. Governing Law

• These Terms are governed by and construed in accordance with the laws of Uttar Pradesh/India, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts of Uttar Pradesh/India for the resolution of any disputes.
